SHA Notice: Protecting Yourself Against Title Fraud

Dear Homeowners,

The Board would like to bring an important matter to your attention regarding a growing form of real‑estate–related crime known as title fraud or deed fraud. While we are not aware of any incidents within our community, this type of fraud has been increasing nationwide, and we believe it is important for all homeowners to be informed and vigilant.

What Is Title Fraud?

Title fraud occurs when a criminal illegally obtains the title to a property—often by using forged documents or stolen personal information—and then attempts to sell the home or take out loans against it without the owner’s knowledge. Because these actions can happen without any physical break‑in or obvious warning signs, homeowners may not discover the issue until significant damage has been done.

Why Awareness Matters

• Criminals often target homes that are paid off, owned by retirees, or not frequently monitored.

• Fraudulent filings can occur at the county level without the homeowner being notified.

• Resolving title fraud can be time‑consuming and costly, even when the homeowner ultimately prevails.

Steps You Can Take to Protect Yourself

While the HOA cannot provide legal advice, we encourage all residents to consider the following precautions:

• Monitor your property records through your local county clerk or recorder’s office. Many counties offer free email alerts when documents are filed against your property.

· Take advantage of Dare County Fraud Alert by visiting: Darenc.com, Click Register of Deeds, click on Fraud Protection. When asked, apply your name on the title and/or the name of your trust and your email address. Once you receive confirmation Dare County will contact you by email any time your name or trust has a request on it.

• Review your credit reports regularly for unfamiliar accounts or inquiries.

• Secure personal information to reduce the risk of identity theft, which is often a precursor to title fraud.

• Consult your insurance provider if you are interested in learning about title monitoring or title insurance options.
